Any patient, guardian, representative, attendant, relative, or affiliate accessing the Platform (“User” or “you”); and
Any individual browsing, registering, or using the Platform in any capacity.

These Terms apply to all services made available by Claritas through its website, digital platforms, or applications, including teleconsultations and related healthcare services.

The services may be modified, updated, or discontinued at the sole discretion of Claritas without prior notice. Your continued use of the Platform constitutes acceptance of any revised Terms.

By accessing or using the Platform, you irrevocably accept and agree to comply with this Agreement. If you do not agree with any part of these Terms, you must refrain from using the Platform or availing any services.

This Agreement supersedes all prior communications or understandings, whether oral or written.

The Agreement is governed by applicable Indian laws, including but not limited to:

The Indian Contract Act, 1872
The Information Technology Act, 2000
Applicable rules, regulations, and guidelines issued thereunder
Any other laws in force from time to time in India

2. Eligibility and Conditions of Use

You must be 18 years of age or older to register and use the Platform independently. By accessing or using the Platform, you represent and warrant that:

You are at least 18 years old;
You possess the legal authority and capacity to enter into this Agreement;
All information provided by you is accurate and complete.

Claritas reserves the sole discretion to grant or withdraw access to the Platform and services at any time.

3. User Account and Data Privacy

3.1 Collection of Information

Claritas may collect information related to:

Devices used to access the Platform

Usage analytics
Contact information such as email address and mobile number

This information is used strictly for service improvement, communication, analytics, and development of new services.

Users must ensure that their mobile number and email address remain updated. Claritas shall not be liable for missed notifications due to outdated contact details.

4. Communication and Teleconsultation Services

Claritas may provide communication services including:

Text messages
Voice calls
Video consultations

Records of such communications may be stored securely in accordance with the Privacy Policy.

By opting for teleconsultation, you acknowledge that:

Telemedicine has inherent limitations.
Diagnosis and treatment are based on information shared by you.
Emergency medical conditions require immediate physical medical attention.

Claritas and Dr. Mayank Bansal shall not be liable for outcomes resulting from incomplete or inaccurate information provided by the User.

5. Personal Health Records

Users may be provided access to manage personal health records. These may include:

User-created information: Uploaded or entered by you.
Claritas-created information: Generated during consultations, diagnostic tests, admissions, or treatments at Claritas.

Claritas-created records are provided on an “as-is” basis.

The accuracy and reliability of User-created information is solely the User’s responsibility. You agree to indemnify Claritas against claims arising from inaccurate data submitted by you.

6. Appointment Booking and Teleconsultation

While Claritas endeavors to confirm requested appointments, confirmation is subject to availability.

Claritas shall not be liable for:

Cancellation, postponement, or rescheduling of appointments
Doctor unavailability
Delays or technical disruptions
Variation in consultation fees

Further, Claritas is not responsible for:

Treatment outcomes
Alleged medical negligence
Post-consultation medical complications
Decisions made by patients based on teleconsultation advice

Users understand that teleconsultation is advisory in nature and does not replace emergency care or physical examination where clinically required.

7. Online Payments

The Platform may enable online payments through third-party payment gateways.

If you choose to make payment online:

You may be redirected to a third-party gateway.
The transaction will be governed by the gateway provider’s terms and privacy policy.

Claritas shall not be liable for:

Service deficiencies of payment gateways
Transaction failures
Delays or downtime
Breach of privacy at the payment provider’s end

Monetary loss due to declined or incomplete transactions

8. Modification and Termination

Claritas reserves the right to:

Modify, suspend, or discontinue any service
Update these Terms at any time
